Beta Test Agreement

This Beta Test Agreement ("Agreement") governs your participation in beta testing programs for new features, tools, or services offered by TryMarq, LLC, a Delaware corporation with registered offices at 131 Continental Dr, Suite 305, Newark, DE 19713, New Castle County, Delaware ("Company"). By accessing any beta feature, you ("Beta Tester" or "you") agree to the terms below.

The Company may, from time to time, offer access to pre-release features, tools, or services ("Beta Features") for testing and evaluation purposes. Beta Features are experimental and may include, but are not limited to: new AI generation models, new content types, enhanced analytics dashboards, API integrations, and experimental UI/UX changes.

Beta access is granted at the Company's sole discretion. Not all users will be invited to participate. The Company reserves the right to revoke beta access at any time without notice or liability. Beta Features may be accessed through feature flags, separate URLs, or opt-in settings within the platform.

As a Beta Tester, you agree to: (a) use Beta Features in good faith and provide honest, constructive feedback; (b) report bugs, errors, and issues promptly through designated channels; (c) not publicly disclose, review, or benchmark Beta Features without prior written consent; (d) understand that Beta Features may not function as expected and may cause data loss; (e) not rely on Beta Features for production or mission-critical workloads.

All Beta Features, associated documentation, communications, and information shared during the beta program are confidential. You agree not to disclose any details about Beta Features to any third party, including on social media, review sites, forums, or in press coverage, without the Company's prior written approval. This confidentiality obligation survives termination of this Agreement for two (2) years.

Any feedback, suggestions, bug reports, enhancement requests, or other input you provide regarding Beta Features ("Feedback") shall become the exclusive property of TryMarq, LLC. You hereby assign all rights, title, and interest in such Feedback to the Company. The Company is free to use, modify, and incorporate Feedback into its products without obligation or compensation to you.

BETA FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. THE COMPANY MAKES NO REPRESENTATIONS REGARDING THE RELIABILITY, AVAILABILITY, FUNCTIONALITY, OR PERFORMANCE OF BETA FEATURES. BETA FEATURES MAY CONTAIN BUGS, ERRORS, AND DEFECTS AND MAY NOT FUNCTION AS INTENDED.

IN NO EVENT SHALL TryMarq, LLC BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF BETA FEATURES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, BUSINESS INTERRUPTION, OR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. YOU USE BETA FEATURES AT YOUR OWN RISK.

This Agreement is effective upon your first access of any Beta Feature and continues until: (a) the Beta Feature is promoted to general availability; (b) the Beta Feature is discontinued; (c) your access is revoked by the Company; or (d) you opt out of the beta program. Upon termination, you must cease using all Beta Features.

Participation in a beta program does not guarantee that the Beta Feature will be released to the general public. The Company reserves the right to modify, delay, or cancel any Beta Feature at its sole discretion without prior notice or liability.

This Agreement shall be governed by the laws of the State of Delaware. Disputes shall be resolved in the courts of New Castle County, Delaware.
